Agreement
These Terms of Use (“Terms”) are an agreement between you and SocialSpot (“we,” “us”) governing your use of the SocialSpot app and website (the “Services”). By creating an account or using the Services, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you don’t agree, don’t use the Services.
Eligibility
You must be at least 18 years old and able to form a binding contract to use SocialSpot. You may not use the Services if you’ve previously been banned, or if you are prohibited from doing so under applicable law.
Your account
You’re responsible for the accuracy of the information you provide and for activity on your account. Keep your sign-in credentials secure and tell us right away about any unauthorized use. You may delete your account at any time; see Delete your account.
Your content
You own the content you add to SocialSpot, such as your photo, bio and links (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, display and transmit Your Content solely to operate and provide the Services. This license ends when you delete the content or your account, except for copies in backups for a limited period. You confirm you have the rights to Your Content and that it doesn’t violate these Terms or anyone else’s rights.
Acceptable use
You agree to follow our Community Guidelines. There is no tolerance for objectionable content or abusive users. You also agree not to:
- Use the Services to stalk, harass, track or harm anyone
- Misrepresent your identity, age or location, or create accounts for anyone else
- Scrape, crawl or collect data about other users, or use bots or automated means
- Reverse engineer, interfere with, or attempt to bypass the security of the Services
- Use the Services for commercial solicitation or any unlawful purpose
We may remove content and suspend or terminate accounts that violate these Terms, with or without notice.
Location features and meeting people
SocialSpot shows your position to nearby users while Share Location is on. Location data may be approximate and is not suitable for navigation or emergencies. We do not conduct criminal background or identity checks on users, and we are not responsible for the conduct of any user on or off the Services. Use caution and good judgment when interacting with or meeting anyone, and follow our safety tips.
Third-party services
The Services let you link to and sign in through third-party services (such as Apple, Google, Instagram or TikTok). Your use of those services is governed by their own terms and privacy policies, and we aren’t responsible for them.
Our intellectual property
The Services, including the SocialSpot name, logo, software and design, belong to SocialSpot and its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by these Terms and the App Store’s Usage Rules.
Termination
You can stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if needed to protect users or the Services. Sections that by their nature should survive termination (such as ownership, disclaimers and limitation of liability) will survive.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT LOCATION INFORMATION WILL BE ACCURATE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOCIAL SPOT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR YOUR INTERACTIONS WITH OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions don’t allow these limitations, so they may not apply to you.
Apple App Store terms
If you downloaded the App from the Apple App Store: (a) these Terms are between you and SocialSpot, not Apple, and SocialSpot, not Apple, is solely responsible for the App and its content; (b) Apple has no obligation to provide maintenance or support for the App; (c) if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and Apple has no other warranty obligation; (d) Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims; (e) Apple is not responsible for any third-party claim that the App infringes intellectual property rights; (f) you represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties; and (g) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes and general terms
We may update these Terms. We’ll post the new version here and, for material changes, notify you in the App or by email before they take effect. Continuing to use the Services after the changes means you accept them. These Terms are governed by the laws of the United States and of the state in which SocialSpot is organized, without regard to conflict-of-laws rules.
